2. Workers’ Compensation and Personal Injury claims work on a contingency fee basis. If you are not familiar with a contingency fee claim, this means that your attorney will take his or her fee as a percentage of your settlement… so you pay nothing up front! So, what is that fee at settlement? In North Carolina, the fee is 25% of the settlement for a Workers’ Compensation claim, and 1/3 (33.33%) of the settlement for a Personal Injury claim (e.g. motor vehicle accident) in most instances. In South Carolina, the fee is 1/3 (33.33%) of the settlement amount for Workers’ Compensation claim and the same for a Personal Injury claim in most instances. These are often referred to as “no win no fee” cases since the attorney only receives a percentage of the settlement. In other words if you do not win your case (the case settles for $0), then the attorney would not receive a fee payment.
3. Are there any other costs associated? Very minimal. There are often nominal costs associated, such as funds to obtain medical records for your treatment. At Shankle Law Firm, we pay these costs up front so that you don’t have to worry about paying anything until the conclusion of your case. Once a settlement has been reached for your claim, these funds would be reimbursed to Shankle Law Firm out of the settlement proceeds.
